1. Definitions

  • User: Any Distributor or Franchisee of ARE&M accessing or utilizing the Portal of Axis Bank for online payment and banking services.
  • Service Provider: Axis Bank Limited, which owns, operates, and manages the portal providing online payment and banking services.
  • Services: The services provided by Axis Bank include, but are not limited to, online payment facilities, fund transfers, account management, transaction monitoring, and other digital banking services made available through its portal.
  • Facilitator: Amara Raja Energy and Mobility Limited (ARE&M), which solely acts as a facilitator by providing access to the Portal of Axis Bank. ARE&M does not provide banking services, does not control the portal, and bears no responsibility for the operation, accuracy, or outcomes of the services offered by Axis Bank.

2. Terms and Conditions

  • Service Provision: Access to the Portal of Axis Bank is provided on an “as is” and “as available” basis. ARE&M does not guarantee or warrant uninterrupted access or error-free functionality. ARE&M reserves the right to suspend or terminate access temporarily or permanently for maintenance, upgrades, or unforeseen technical issues.
  • No Warranty: While ARE&M strives to ensure smooth facilitation, no warranties or representations are made regarding the completeness, reliability, or suitability of the content and services offered by Axis Bank. All warranties, express or implied, are disclaimed.
  • Limitation of Liability: Under no circumstances shall ARE&M be held liable for any direct, indirect, incidental, or consequential damages arising from the use of Axis Bank’s portal, including but not limited to loss of data, financial loss, or system failure. All liabilities rest with the Service Provider (Axis Bank).
  • Third-Party Services: The portal may contain links to third-party websites or services. ARE&M is not responsible for the content, privacy practices, or reliability of such external resources.
  • User Responsibility: Users are responsible for maintaining the confidentiality of their login credentials and ensuring the accuracy of information provided during transactions. In case of discrepancies regarding refunds or chargebacks, the responsibility lies solely with Axis Bank, and ARE&M shall have no involvement or liability.
  • Regulatory Compliance: All services are subject to applicable laws and regulations, including guidelines issued by the Reserve Bank of India (RBI), the Information Technology Act, and the Digital Personal Data Protection Act along with applicable Rules. Axis Bank, as the Data Fiduciary and Data Processor, warrants to process user data in compliance with these regulations. ARE&M is expressly relieved of any responsibility in this regard.
  • Modifications: ARE&M reserves the right to modify this disclaimer at any time without prior notice. Continued use of Axis Bank’s portal constitutes acceptance of the updated terms.
  • Severability: If any provision of this disclaimer is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
  • Governing Law: This disclaimer shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana. Amara Raja Energy and Mobility Limited (ARE&M) is only a facilitator providing access to Axis Bank’s portal. ARE&M does not provide banking services, does not process transactions, and bears no responsibility for the accuracy, security, or outcomes of services offered by Axis Bank. All obligations, warranties, and liabilities rest solely with Axis Bank as the Service Provider.

3. Privacy Policy

  • Security and Data Privacy: ARE&M has implemented reasonable measures to protect user data during facilitation. However, ARE&M cannot guarantee absolute security and is not liable for unauthorized access or data breaches by Axis Bank. Users are advised to review Axis Bank’s Privacy Policy for details.

4. Refund and Cancellations:

  • Notwithstanding anything contained herein, in the event that any amount is debited from the customer’s account but is not credited to ARE&M due to any technical malfunction, system error, or payment gateway failure, such amount shall be liable to be refunded by Payment Gateway provider in accordance with its internal refund policies and guidelines. The refund processing period shall, in any case, not exceed seven (7) working days from the date of such failed transaction.
